On inquiry, Jockey HS Gill (SILVER JOY) pleaded guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that he shifted out at the 450M causing ORDOS LEGEND to check.
In assessing the penalty, the Stewards took into consideration Jockey HS Gill’s guilty plea, mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of two (2) Malaysian race days, to be deferred, with effect from 18 September 2023 and to expire on 24 September 2023, both dates inclusive. He was advised of his Right of Appeal.

RACE 4 (R0971) CLASS 5A – 1100M (SC E)
1 BATTLESTAR
(HS Gill) Tightened shortly after the start and veered outwards to avoid runners near the 100M.
2 RUNNING SPIRIT
(KP Lim) Raced wide in the early stages and had to be checked near the 150M. *(See Report)

(SU Lim) Carried outwards between the 200M and the 100M. *(See Report)
4 GOLD SKY EXPRESS
(MM Firdaus) Bumped at the start and drifted out when tiring, causing runner to check. *(See Report)

On inquiry, it was established that GOLD SKY EXPRESS (MM Firdaus) which was tiring, drifted out, carrying SORBETA outwards causing RUNNING SPIRIT to be restrained. Whilst considering that Jockey MM Firdaus had ridden in a careless manner, after taking into consideration his particularly good record, the Stewards reprimanded him for this incident.

RACE 5 (R0972) CLASS 5A – 1100M (SC E)
1 MIGHT IS RIGHT

(J Low) Raced fiercely in the early stages, throwing its head and drifted out, brushing runner near the 250M, continued to drift out in the straight.

(M Ewe) Slow into stride. Brushed from his inside near the 250M and carried outwards.

(L De Souza) When racing fiercely, travelled wide in the early and middle stages.
Jockey MM Firdaus was examined by the Club Doctor who subsequently stood him down from his riding engagements for his remainder rides.

RACE 6 (R0973) CLASS 4B – 1250M (LC E)

(L De Souza) Bumped heavily at the start, losing ground and held up for a clear run near the 250M.

(M Ewe) Impeded and unable to secure a clear passage between the 600M and the 150M.

RACE 7 (R0974) SUPREME C – 1400M (LC E)
Due to regional rescheduling, this race was rescheduled to start at 4:20pm.

(J De Souza) Threw its head when racing fiercely at the 1100M.

(HS Gill) Inclined to lay inwards in the straight.

(J Low) Dwelt when the start was effected, losing considerable ground, travelled wide and was eased down in the straight. Rider advised that the gelding was not striding well throughout the race and shifted ground considerably. Vet inspection: No significant finding. - 1000M/vet & to be presented to the Vet for a thorough evaluation.

On inquiry, Jockey WW Cheah (IRONCLAD) was found guilty of a charge under MRA Rule 41(6)(b) for excessive use of the whip. After taking into consideration Jockey WW Cheah’s recent record related to whip use, he was fined RM3000/- and advised of his Right of Appeal.
Jockey WW Cheah was examined by the Club Doctor who subsequently stood him down from his riding engagements for his remainder rides.

RACE 9 (R0976) CLASS 4B – 1250M (LC E)
2 RADETZKY MARSCH
(HS Gill) Raced wide in the middle stages.
3 OISIN EXPRESS
(L De Souza) Near the 950M, tended to baulk and then restrained to avoid the heels of runner. Raced erratically in the straight. Rider explained that he had intended to lead on the gelding, however, after obtaining the lead, it had commenced to baulk and shy near the 1000M from the running rail. Further, it had backed off and had shortened its stride. He had then been crossed and momentarily steadied. He was at a loss to explain why the gelding had acted in his manner.
4 APIS
(E Ferreira) Jumped outwards at the start, striking the gate with rider dropping his whip. Shifted in causing runner to steady near the 950M. The Stewards inquired into the rider’s riding over the concluding stages when whipless. *(See Report)

(App S Shazmin) Cast its near hind plate and had to be replated causing a delay.
9 CONSTANT JUSTICE
(S Hafis) Jumped awkwardly, losing ground.
10 STAR FIFTYTWO
(APP R Nuqman) Slow into stride and raced wide throughout.
Jockey E Ferreira explained that after dropping his whip at the start, when in a prominent position near the 300M, he had removed his cloth cap and used it on four (4) occasions in a waving manner in an endeavour to encourage the horse to perform. He advised that this was not uncommon in his home country of Brazil. Whilst accepting his explanation, the Stewards did not apply a fine related to the drop whip given that he had struck the barrier on exiting, however, warned Jockey E Ferreira that he is not permitted, in future, to use any part of his apparel and use it in a manner to goad this horse given that nothwithstanding other issues, the waving of an item such as a cloth cap may distract or frighten other runners.
